Terms of Service

These terms cover mniznik.com and the software I run under my own name, including the tooling I use to publish to my own social accounts. Using the site means you accept what is written here.

I am Mat Niznik, an independent professional. This site is my personal brand. It shows my work, hosts my writing, and gives people a way to reach me. Nothing is sold through it, no account is created on it, and no payment is taken on it.

What this site is

The site is informational. Everything on it is published so you can decide whether to talk to me about work. Reading it, downloading a résumé, sending the contact form, or booking a call creates no contract and no obligation on either side. Any actual engagement is agreed separately and in writing.

Who may use it

The site is aimed at a professional audience and is not directed to children. If you are under 16, please do not send me your information through the contact form or the booking calendar.

Acceptable use

Use the site normally and this section will never matter to you. Specifically, please do not:

  • attempt to gain access to any part of the site, its server, or my accounts that is not public
  • interfere with the site’s operation, including by overloading it or probing it for vulnerabilities without my written permission
  • use the contact form or booking calendar for unsolicited sales, recruitment spam, or automated submissions
  • scrape or bulk-copy the site’s content to train a model or to republish it as your own

If you find a genuine security problem, tell me at the address below. I will not pursue anyone who reports something in good faith and gives me a reasonable chance to fix it.

My content

The writing, design, code, images, and case studies on this site are mine, or are used with permission, and remain so. You are welcome to read, share a link, and quote a short passage with attribution. Republishing a whole piece, or using anything here commercially, needs my written permission first. Client names and project work appear only where I have the right to show them.

Your content

Anything you send me - a message, booking notes, files shared during a project - stays yours. You give me permission to read it, store it, and use it for the purpose you sent it for, and nothing else. How it is handled is described in my privacy policy. Please do not send me confidential material before we have agreed how to handle it.

The tooling behind my social accounts

I build and run my own software to publish to social platforms including Instagram, TikTok, and LinkedIn. That software is private, not offered to anyone else, and not available for sale or signup. There is no user account to create and no data of yours in it.

It authenticates only as me, against each platform’s official API, using tokens I have granted to it myself, and it publishes only content I have made and approved. It does not act on behalf of other people, post to accounts I do not own, automate engagement with your posts, or collect data about other users. It operates within each platform’s own developer terms, and those terms govern anything that happens on the platform itself.

Links and embedded services

The site links to other places and embeds a booking calendar and video player. Those services have their own terms and their own reliability, and I do not control either. A link is not an endorsement.

No warranty

The site is provided as it is. I keep it accurate and online because I want it to be, not because I have promised you it will be. Content may be out of date, and the site may be unavailable while I change something. Nothing here is professional, legal, or financial advice, and reading it does not make me your advisor.

Limits on liability

To the extent the law allows, I am not liable for indirect or consequential loss arising from your use of this site, and my total liability for anything connected to the site is limited to one hundred US dollars. This does not limit liability for anything that cannot be limited by law, including fraud. If we work together, that engagement’s own agreement governs it, not this paragraph.

Governing law

These terms are governed by the laws of the State of California, in the United States, and any dispute belongs in the state or federal courts of Los Angeles County, California.

Changes

I will update these terms when what I actually do changes. The date at the top always reflects the current version. Continuing to use the site after a change means you accept the updated version.
